SHOULD I GO TO A DOCTOR FOR MY PERSONAL INJURY CASE?

The short answer is yes.  If you are injured or believe you may be injured, go to your doctor. It can be your family physician, the local urgent care or the emergency room.

The unfortunate truth is that if you wait and try to “tough it out” and find out later (a few months after the accident) that you truly are injured and need treatment, the liability insurance carrier is likely to deny your claim.  This is referred to as the “Gap in Treatment” defense.

They will argue that if you were injured, you would have seen a doctor immediately after the collision.  They will argue that you must have done something else AFTER the accident that is causing these injuries and unfortunately, it is an easy argument for a jury to believe. 

If you are injured, get treatment and be sure that your injuries are well documented by your doctors.  If you are NOT injured, there is no reason to go to the doctor.
